Terms of Use

The service

Brotia identifies and diagnoses plants from a photo or text description and helps you care for them with care plans, reminders and an AI coach. Identifications, diagnoses and care tips are generated automatically and are approximate.

Plans and subscriptions

Brotia offers a free tier and a paid subscription. The free tier lets you perform up to 5 plant identifications a day. Brotia Premium is an auto-renewing subscription billed monthly at approximately €4.99/month (or the local-currency equivalent shown in the App Store at the time of purchase), and unlocks unlimited identifications and diagnoses, care reminders, the AI plant coach and an unlimited, synced and backed-up collection.

• Free: up to 5 identifications a day, at no cost.
• Brotia Premium: monthly auto-renewing subscription, approximately €4.99/month or the local-currency equivalent shown in the App Store at the time of purchase.
• Payment is charged to your Apple Account when you confirm the purchase.
• The subscription renews automatically unless cancelled at least 24 hours before the end of the current period; the renewal is charged to your account within 24 hours before the end of the period.
• Manage or cancel your subscription anytime in your Apple Account Settings.
• Apple is the merchant of record for purchases made through the App Store; refunds are handled by Apple under its policies.

Acceptable use

You agree to use Brotia only for lawful, personal purposes. You will not misuse the app, attempt to disrupt or reverse-engineer it, upload unlawful content, or use it in any way that infringes the rights of others.

No professional advice

Brotia is an informational tool. Its plant identifications, diagnoses and care tips are not professional horticultural, agronomic, veterinary or medical advice, and are not a substitute for professional guidance. Some plants are toxic to people or pets; do not rely on Brotia to decide whether a plant is safe to eat, handle or keep around children or animals. Consult a qualified professional before making decisions based on the app.

Intellectual property

Brotia, its name, logo, software and content are owned by CrawlSense and protected by law. We grant you a limited, non-exclusive, non-transferable licence to use the app for personal purposes. Your plant data and photos remain yours.

App Store terms (EULA)

Brotia is licensed, not sold, to you, and may be used only under Apple's Licensed Application End User License Agreement (the standard EULA), available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/ , except to the extent these Terms expand on it. The following Apple-required terms also apply:

• These Terms are between you and CrawlSense only, and not with Apple. CrawlSense, not Apple, is solely responsible for Brotia and its content.
• Apple has no obligation to furnish any maintenance or support services for Brotia; CrawlSense is solely responsible for support, which you can reach at support@crawlsense.ai.
• Apple is not responsible for any product warranties, whether express or implied. If Brotia fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple will have no other warranty obligation regarding Brotia.
• Apple is not responsible for addressing any claims by you or a third party relating to Brotia, including product liability, regulatory or intellectual-property claims; such claims are governed by these Terms and handled by CrawlSense.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting", and that you are not listed on any U.S. Government list of prohibited or restricted parties, and you agree to comply with all applicable export-control laws.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right (and will be deemed to have accepted the right) to enforce these Terms against you.

Privacy

Your use of Brotia is also governed by our Privacy Policy, available at /brotia/privacy, which explains what data we collect, how the AI processing and plant-photo storage work, and the choices and rights you have.

Limitation of liability

To the maximum extent permitted by law, Brotia is provided "as is", without warranties of any kind. We are not liable for indirect, incidental or consequential damages, or for decisions you make based on the app's estimates — including any harm to plants, people or pets.

Governing law

These Terms are governed by the laws of Spain, without regard to conflict-of-law rules, and are subject to the mandatory consumer protections of your country of residence.

Changes to these terms

We may update these Terms as the app evolves. We will update the "Last updated" date and, for material changes, notify you in the app. Continued use after changes means you accept them.
